Completed an accounting reconstruction of loan balances and financial statements over a four year period for the private companies of a high net worth individual.  The reconstruction was required by the client in response to ATO enquiries into historical tax returns.  The reconstruction identified a number of errors in the previous accounting presentation and disclosure and resulted in a restatement of the financial statements for four financial years.

Investigated the non-disclosure of key balance sheet items by the National Bank of Tajikistan to the International Monetary Fund.  Responsible for managing the team’s audit of the work undertaken by the bank to correct this non-disclosure, including understanding complex concealment of transactions and conducting interviews with senior bank officials.

On behalf of the Volcker Commission, was a senior member of the team in Switzerland engaged to determine the existence of dormant bank accounts and assets at a global Swiss financial institution which allegedly belonged to the victims of Nazi persecution.

Led the tracing of approximately $1 billion of dividend payments from numerous subsidiaries through to parent entities.  The work was part of the defence to an investigation into a complex intra-company dividend arrangement within the context of a large taxation dispute.

Facilitated business ethics training for a public sector client.

Instructed by a legal firm on behalf of an insurer to respond to an independent expert accountants report quantifying the loss and damage allegedly suffered due to a fire in a printing business.

Advised a government agency on loss of profit claims made against it by a hotel manager following disruption to the trading of one of its hotels due to business interrupting events.

Advised a European retailer of the economic loss it suffered following the closure of a major retail development due to ground subsidence.

Undertook the analysis, investigation and data warehousing of all electronic information and data captured as a result of the collapse of HIH Insurances Limited.  In addition, developed an e-evidence solution to allow electronic records to be made available to all requesting parties.

Engaged to provide expert witness services by an Australian broadcasting corporation in relation to a broadcasting rights dispute.

Assisted a Commonwealth agency with the execution of court orders to identify and capture electronic evidence from an internet service provider.  Was also appointed as joint expert to conduct further examination of the data captured.

Provided technical advice and training to a law enforcement agency in relation to covert computer techniques used to identify internet based paedophiles.  In addition, also developed a software tool that was subsequently used by the majority of law enforcement agencies in Australia and which received a Queensland award for innovation.

Provided forensic technology assistance in respect of the recovery and analysis of electronic evidence to support an investigation into unlawful and inappropriate activity by a number of staff at a Brisbane based Non Government Organisation.

Engaged to provide forensic technology assistance by the legal advisers of an Australian manufacturing company, including the execution of a number of Anton Pillar orders and undertaking a detailed examination of the recovered information.

Provided on-going forensic technology assistance to a large financial services organisation in relation to numerous internal investigations where there was a heavy reliance on electronic evidence. This work comprised the preservation, capture, analysis and reporting of electronic evidence.

Engaged to provide forensic technology by ASIC to execute various search warrants in conjunction with the Australian Federal Police.

Provided on-going forensic technology support to a large Australian based retailer in respect of numerous internal investigations which required data recovery, analysis and reporting of electronic evidence.

Provided forensic technology support as part of the receivership of Evans and Tate Limited.

Provided forensic technology support as part of the receivership of Commander Communications.

Engaged by the ACCC to quantify the value of underpaid Airtime commissions by a Telecommunications Reselling Franchisor to 63 of its Franchised stores.  The work comprised compiling and analysising millions of individual transactions over a prolonged period of time using data analytic techniques.

Extracted sales data and constructed a complex financial model to estimate the potential value of claims against the pharmaceutical company by customers and other third parties following the largest product recall in Australia.  The analysis was used by the acting directors to make critical decisions regarding the future of the company.

Project managed and subsequently led the forensic team acting as independent expert for a global energy and natural resources business, quantifying class action claims for property damage and consequential losses arising from the interruption of the gas supply to business and domestic users in Victoria following the Longford fire and explosion.

Appointed by a legal firm to assist its client in conducting an investigation into allegations of anti-competitive pricing behaviour.  The investigation included the identification, capture, restoration and targeted review of tens of thousands of documents, both electronic and hard-copy, the creation of a chronological time series of meetings and telephone calls held between relevant parties to the matter and the presentation of findings to the competition regulator.

Conducted an internet and email compliance audit on behalf of an international mining company.  The results of the compliance review were reported to management and required the subsequent investigation of a number of employees.

Undertook systems compliance reviews in the local and state government sectors, including assessment of compliance with regulatory requirements and identification of opportunities to enhance business systems.

Appointed by the NSW government to undertake an investigation into allegations of corrupt behaviour in connection with the alleged preferential treatment of awarding contracts to suppliers.  Reviewed financial records, interviewed employees and senior management, conducted corporate searches and captured electronic data.

Engaged to investigate allegations of misconduct and financial impropriety at an Australian University.  The investigation considered alleged conflicts of interest, alleged misuse of the Universities intellectual property and alleged improper transactions between related parties.

Investigation into alleged inappropriate behaviour and conflicts of interest by employees.  It was alleged that several suppliers were companies in which several employees had direct interests.

Engaged by the legal advisers of a waste management company to prepare an independent expert accountants report quantifying the loss and damage suffered by their client arising from the actions of a state owned corporation who allegedly prevented their client from building a materials recycling facility.

Provided expert evidence in the Patrick and Toll closed arbitration involving financial claims of between $300 and $500 million (as quoted in the press). As publicly reported, the dispute centred on a contract under which Toll provided services to Pacific National Limited (PNL) in North Queensland. Patrick claimed that Toll benefited from the deal, which would create a $510 million revenue shortfall for PNL over 20 years.

Instructed as an independent accounting expert on behalf of a NSW State Government owned transport organisation which was defending a claim for loss and damage made against it by a transport company for breach of contract.

Instructed as an independent accounting expert on behalf of a listed telecommunications business to respond to a claim for loss and damage arising from an alleged breach of contract.

Provided accounting advice to a financial institution on the potential breach of loan covenants.  The client alleged that the payment of dividends had caused a customer to breach the level of profits required under a loan covenant.  Expert advice was provided on the distribution of profits permitted under Australian Accounting Standards and the Corporations Law as well as an analysis of actual distributions;

Undertook an investigation into suspicions of fraud, corruption and conflicts of interest involving falsification of property titles in Kingston, Jamaica. This assignment included the review of records, interviews with staff and informants and liaising with local police.

Appointed by a public utility to investigate protected disclosures alleging improper conduct involving a senior employee.  The work involved the review of documentation and interviewing employees, related parties and members of the Board of Directors.

Engaged to investigate allegations of corruption involving senior executives of a large listed Australian retailer, which identified inappropriate dealings with the company’s suppliers.  Their employment was subsequently terminated.

Quantified the losses suffered by a consultant pursuant to an allegation of defamation regarding an article published in a leading business magazine.

Provided investigative forensic services to the Liquidator of HIH Insurance Limited, including the review of electronic evidence as well as an analysis of events and timeframes leading up to the occurrence of significant transactions.

Assisted in the preparation of an expert report calculating the economic loss suffered by a private electricity generation company in the Northern Territory.  The government was found to have breached the Trade Practices Act and were to pay damages to the company.  The quantification of loss involved a detailed analysis of the electricity generation business and electricity markets in Australia.

Quantified the alleged loss and damage suffered by eight printing and graphical reproduction franchises arising from a dispute regarding alleged negligent financial information contained in a prospectus which had induced the franchisees to enter into the franchise agreement.

Prepared an expert report calculating the economic loss suffered by a swimming pool manufacturer resulting from the supply of a defective resin for use in the manufacturing process. The swimming pools suffered blistering and required replacement. The work included the quantification of loss based on three scenarios of expansion forecast by the business at the time of supply;

Assisted a major publicly-listed Australian steel company quantify losses suffered following an alleged breach of a non-compete clause pursuant to the sale of a business.

Quantified the losses incurred by an air conditioning installer forced to re-install faulty air conditioning units.

Assisted a regulator with their representative action to quantify the losses suffered by investors (predominantly retirees) who borrowed significant amounts of funds via margin loans to invest into products offered by a financial services firm who subsequently lost their investments when the firm was placed into liquidation.

Engaged by an events manager to defend a breach of contract claim in relation to major sporting events that were to be rolled out in Asia.  The events manager terminated the agreement and the plaintiff had lodged a claim for damages.

Engaged by legal advisers to provide electronic discovery assistance in relation to a class action litigation including the production of data and the identification of relevant data.

Managed numerous large electronic discovery matters which involved providing specialist support in scoping and identifying sources of electronic data, capturing, searching and filtering electronic data, processing data in accordance with agreed protocols and producing results compatible for use in recognised legal review applications.

Assisted with the investigation on behalf of a State government department in relation to the department’s provision of services and assistance to a convicted child sex offender.  The work involved establishing the factual circumstances of the assistance provided by the department, the relevant policies and procedures in place and whether such policies and procedures had been breached;

Managed a team investigating an employee at an investment bank suspected of sending out unauthorised letters of representation on behalf of the bank.  Coordinated the targeted review of electronic data in order to identify the scale of the issue so that the bank could contact the necessary third parties.

Engaged to review the relationship between our client and an IT supplier, with a  view to establishing the appropriateness of transactions and conduct by our client's staff.
